1. Meanings
  1. "Atrocities" an extremely wicked or cruel act, typically one involving physical violence or injury.
  2. "Commission " a group of people entrusted by a government or other official body with authority to do something.
This Act is used to prevention of offences against Schedule Caste and Schedule Tribe People, as Well as Tribal areas
That to provide a Special Court to trail of Such offences, and relief and "rehabilitation" of the victims for such offences and for matters connected therewith or incidental "thereto".

PRELIMINARY
1. Short Title
  1. This Act may be Called as SC and ST Act of 1989
  2. It extends to the whole of India except the State of Jammu & Kash- mir.
  3. It shall come into force on such date as the Central Government may, by notification in the Official Gazette, appoint.

2. Definitions
  1. Atrocity” means an offence punishable under section 3;
  2. "Code” means the Code of Criminal Procedure, 1973 (2 of 1974);
  3. Scheduled Castes and Scheduled Tribes” shall have the mean-ings assigned to them respectively under clause (24) and clause (25) of article 366 of the Constitution:
    1. (24) Scheduled Castes means such cases, races or tribes or parts of or groups within such castes, races or tribes as are deemed under Article 341 to be Scheduled Castes for the purposes of this Constitution;
    2. (25) Scheduled Tribes means such tribes or tribal communities or parts of or groups within such tribes or tribal communities as are deemed under Article 342 to be Scheduled Tribes for the purposes of this Constitution;
  4. Special Court” means a Court of Session specified as a Special Court in section 14;
  5. Special Public Prosecutor” means a Public Prosecutor specified as a Special Public Prosecutor or an advocate referred to in section 15;
  6. words and expressions unsed but not defined in this Act and de-fined in the Code or the Indian Penal Code (45 of 1860) shall have the meanings assigned to them respectively in the Code, or as the case may be, in the Indian Penal Code.

  7. Any reference in this Act to any enactment or any provision thereof shall in relation to an area in which such enactment or such provision is not in force, be construed as a reference to the corresponding law, if any, in force in that area.

OFFENCES OF ATROCITIES
1. Punishment for offences of atrocities.
  1. 3. (1) Whoever, not being a member of a Scheduled Caste or a Scheduled Tribes.
  2. Who Commit Offence against SC and ST, may Punished Under Section 3, as per Above Defintions
    1. Section 3(i) forces a member of a Scheduled Caste or a Scheduled Tribe to drink or eat any inedible or obnoxious substance;
      1. Inedible
        uneatable, indigestible, unconsumable, unpalatable, unwholesome, unsavoury
      2. Obnoxious
        extremely unpleasant

    2. (ii) acts with intent to cause injury, insult or annoyance to any member of a Scheduled Caste, or a Scheduled Tribe by dumping excreta, waste matter, carcasses or any other obnoxious substance in his premises or neighbourhood

        waste matter discharged from the body, especially faeces and urine
    3. forcibly removes clothes from the person of a member of a Schedul-ed Caste or a Scheduled Tribe or parades him naked or with painted face or body or commits any similar act which is derogatory to human dignity;

        procession, march, cavalcade, motorcade, cortège, ceremony, spectacle, display, pageant, concours, file, train, column; More array, review, muster, dress parade, tattoo;
      2. Derogatory
        showing a critical or disrespectful attitude
      3. Section 3(3) Forcibly Remove Clothes
    4. (iv) wrongfully occupies or cultivates any land owned by, or allotted to, or notified by any competent authority to be allotted to, a member of a Scheduled Caste or a Scheduled Tribe or gets the land allotted to him transferred;

    5. wrongfully dispossesses a member of a Scheduled Caste or a Scheduled Tribe from his land or premises or interferes with the enjoyment of his rights over any land, premises or water

    6. compels or entices a member of a Scheduled Caste or a Scheduled Tribe to do ‘begar’ or other similar forms of forced or bonded labour other than any compulsory service for public purposes imposed by Government;

        attract or tempt by offering pleasure or advantage
      4. Begar
        compulsory labor, as for the repair of bridges or roads
